January 18, 2022

 

 

Laurie opened the public hearing for a subdivision application at 6 PM.

Residents present were Gary Dorman, Donna Davis, and Ann Bond.

Members presiding, Laurie Clark, Darlene Bagley Barbara Peavey, and Nicole Choquette.

CEO Al Tempesta was also present. TM Lois Jones arrived shortly before the close of the meeting.

 

Resident’s questions were answered by Mr. Tempesta and Mr. Dorman. Explanations were given as to the property being purchased by Perfect Fit and what development is anticipated.  Public hearing was closed at 6:10 PM.

 

Laurie called regular meeting to order.

Barbara made a motion to accept minutes of the November 16, 2021 meeting. Darlene 2nd.  All in favor

 

New Business:

Perfect Fit Subdivision

A preliminary application was received via email from the town. The map from the surveyor was presented. Reviewing the application, several items needed correction, verification or submissions were not included.

#7. No evidence of ownership was attached. The deed we received was not for the school property, but a lot that was recently sold from the school property. We requested copies of the deeds from which the survey was based upon including all covenants, deed restrictions, easements, rights of way, or other encumbrances currently affecting the property.

#9. Location of property was not complete. The assessor's map and the tax collector both shown lot 96 as a separate lot from the school and this was not indicated on the application. The application showed lot 97 only. The plat shows that lot 96 is part of the school property but contradicts the town maps. We asked to have lot 96 included on the final application because it appears on the plat plan as part of the property.

#12. There were two entries for acreage on the application. We discussed this with Lois and the board agreed, that the land being developed should be corrected to read 6.031acres.

#14. We asked for the applicant to double check the subdivision maps for the town. A subdivision of the Eastland Elementary School appears on a list of subdivision maps for the town. If this is correct, we requested that the answer be corrected on the application.

#17. The application was left blank. The surveyor conveyed to the TM that this was not in a flood zone. Application should be corrected.

#18. It was determined that no acreage should be entered here as the land is not being dedicated. Application should be corrected.

#21. Anticipated date of construction. Application included the date as January 19, 2022.

This date was questioned as town regulations and State laws indicate that a complete application must be approved and recorded in the Registry of deeds prior to construction, and that selling, offering to sell or convey, or lease any land in a subdivision which has not been approved and recorded shall be punished by a fine and the application has not been approved to date. Gary Dorman read a letter he received from the TM Lois stating that the town’s attorney does not believe this would be a problem. The Board did not receive this correspondence prior to the meeting.

#25. Regulations require a written statement from the servicing water district when water is to be supplied by public water. Because of the wording of ‘is to be supplied’ and the water is already supplied, it was debatable as to the need of such a written statement.

#26. Regulations require a written statement from the sewer district when disposal is to be connected to the public system. Since the system is already connected and is not going ‘to be accomplished by connecting’ (as the wording in the regulations indicate) this was debatable as it is already connected.

#29. The application implied that no waivers were being requested. However, required submission outlined in the town’s subdivision regulations require the following, A high-intensity soil survey, contour lines in relation to mean sea level, a hydro-geologic assessment, a traffic impact analysis, and an estimate of vehicular traffic. We asked the applicant to complete a written request asking for waivers of these submissions since these submission requirements were not included with the application.

 

Darlene suggested that we add a submission requirement of storm-water management with the application since the property contains an easement for such. It was discussed to see if the town could locate the maps indicating where the water mains, culverts, and drainage ways were located on the property since an easement pertaining to the property provided for storm-water drainage and add this information to the application submissions.

 

A list of the additional requirements will be sent to the town. Next meeting will be held Tuesday, January 25th, 2022, at 6pm. Barb motioned to adjourn meeting. Nicole 2nd. All in favor. Meeting adjourned at 7:20 PM.
